Terms of Service — HCzip

1. Acceptance of Terms

By accessing or using HCzip (hczip.com), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the platform.

HCzip is a marketplace platform connecting homecare workers, agencies, and families in New York City. We are not an employer or employment agency.

2. Eligibility

To use HCzip you must:

Be at least 18 years of age.
Have the legal right to work in the United States (for caregivers).
Provide accurate and truthful information during registration.
For agencies: hold a valid New York State license (LHCSA, CHHA, FI, or equivalent) where required.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at support@hczip.com of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these terms, provide false information, or engage in fraudulent activity.

4. Caregiver Profiles

Caregivers agree that:

All certifications and credentials listed are accurate and current.
Profile information is truthful and not misleading.
HCzip may verify certifications against public records and NYSDOH databases.
Profiles that cannot be verified may be suspended pending review.

5. Agency and Employer Accounts

Agencies and employers agree that:

All job postings are for legitimate homecare positions.
Advertised pay rates and conditions are accurate.
Licensed agencies will provide valid license numbers upon registration.
Job postings comply with applicable New York State employment laws.

6. Prohibited Conduct

You may not:

Post false, misleading, or fraudulent information.
Harass, threaten, or harm other users.
Use the platform to solicit users off-platform to avoid fees.
Scrape, copy, or redistribute platform data without written permission.
Attempt to bypass platform security or access restricted areas.
Create multiple accounts to circumvent suspensions.

7. Platform Role and Disclaimer

HCzip is a marketplace platform only. We do not employ caregivers, and we are not responsible for the conduct of users, the quality of care provided, or the accuracy of information posted by users.

Background checks and credential verification are the responsibility of the hiring party. HCzip verification badges indicate that license numbers have been provided — they do not constitute endorsement of any user.

8. Credits and Payments

Some features on HCzip require credits. Credits are non-refundable except as required by law. Credit balances do not expire. We reserve the right to modify credit pricing with 30 days' notice to registered users.

9. Intellectual Property

The HCzip name, logo, and platform design are our intellectual property. User content (profile descriptions, photos) remains owned by the user, but you grant HCzip a non-exclusive license to display it on the platform.

10. Limitation of Liability

To the maximum extent permitted by law, HCzip is not liable for any indirect, incidental, or consequential damages arising from your use of the platform, including damages related to employment relationships formed through the platform.

11. Governing Law

These Terms are governed by the laws of the State of New York. Any disputes shall be resolved in the courts of New York County, New York.

12. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email or in-app notice at least 14 days before taking effect. Continued use of the platform after changes constitutes acceptance.
